The Code does not identify which organisation will host and administer the Code Administration Committee or what powers of investigation the Committee will have. This is extremely important in giving the Code more ‘teeth’.

Membership of the Committee does not identify the inclusion of Indigenous people. It is recommended there be at least two Indigenous people on the Committee.

Dispute resolution: there is value in providing examples of which agencies or individuals might be expected to play a mediation role.

The Code should identify who will pay for the cost of mediation, if a claimant is unable to pay for this themselves.

Remuneration for artworks other than cash is acceptable, so long as the transaction process from the artist to the buyer is completely transparent.

It is important this document has the scope to be further reviewed and modified after 12 - 24 months of implementation. Inevitably, unanticipated applications of the Code will arise once the Code is operating in the public and commercial domain.

It is essential that a well targeted consumer education and information campaign accompany the release of the final Code of Conduct to maximise its impact.
